An arrest for a DUI happens under all sorts of circumstances, but every arrest follows a certain legal protocol.  The arresting police officer must follow certain steps for your DUI charges to be legally valid.  Remember that even if you are arrested, you have rights that are not to be violated.

The first part of any DUI arrest is you, the driver of the car making some sort of driving error to give a nearby police officer probable cause to pull you over.  The officer must have probable cause to pull you over, or else your charges will be dropped.  After pulling you over, the officer will ask to see your driver’s license, registration, and proof of vehicle insurance.  While you search for your documents, the officer will observe you and ask you some questions about where you’ve been to detect any signs of impairment such as being unable to find your license or slurring your speech.  If you do seem intoxicated, the officer will then ask you to step out of the car.

At this point, you should not submit to any field sobriety or chemical tests.  Although a crime in other states, you have the right to refuse a chemical test in the state of Nevada while in the field.  Now if the officer chooses to arrest you and takes you down to the station, at this point you must submit to a chemical test (most likely a blood test.) If your BAC level is above the legal limit, you will be booked on a formal DUI charge.
