In the state of Nevada, the penalties for DUI offenses are as follows:
First Offense
- Up to 6 months in jail or;
- Up to 96 hours of community service
- Nevada DUI School
- Fines up to $1,000 plus court costs
- Nevada Alcohol Victim Impact Panel
- If you’re under 21 or if your BAC was .18% or higher, an alcohol/drug dependency evaluation that costs $100
- If your BAC was .18% or higher, an alcohol or drug abuse treatment program
- If your BAC was .18% or higher, a Breath Interlock Device in your car for up to to 36 months
- If your BAC was less than .18% the court may order the Breath Interlock Device up to 6 months depending on the circumstances
- 90 days suspension of your driver’s license and a $35 civil penalty fee
Second Offense (Within 7 Years of First)
- Up to 6 months in jail or a residential confinement
- Fines up to $1,000 or an equivalent number of hours of community service
- Nevada Victim Impact Panel
- An alcohol/drug dependency evaluation that costs $100
- 1 year driver’s license suspension or revocation, 5 day registration suspension, and a $35 civil penalty fee
- A court-mandated alcohol or drug abuse treatment program
- If your BAC was .18% or higher, a Breath Interlock Device will be installed on your car for up to 36 months as a condition of obtaining a restricted license or reinstating your license. (If your BAC was less than .18%, the device will be installed for up to months.)
Third Offense (Felony Charge, Class B)
- State prison time of up to 6 years
- Fines up to $5,000
- Victim Impact Panel
- A Breath Interlock Device installed on your car for up to 36 months after your release.
- License suspension for 3 years, 5 day registration suspension, and a $35 civil penalty fee
- A court-mandated alcohol & drug evaluation
Punishment for DUI Causing Injury or Death
- Up to 20 Years in Prison
- Fines Up to $5,000
